When can a restraunt be wired in Romex?

When it meets the requirements of 334.10. Check with the building department to get what classification it is. I will also tell you that NM cable cannot be used above a drop ceiling in other than residential work.
 
When it is built of Type III, IV or V construction and the construction is nonrated. Take a look at 334.10(3).

Also be aware that from a NEC standpoint NM cable is not permitted to be installed above a suspended or dropped ceiling. (See 334.12(A)(2))

The only thing I mentioned that you didn't was the rated construction part. NM cable is not permitted to be installed in a restaurant if the restaurant is built out of fire-rated construction.

Or if it meets the criteria of a place of assembly. Those rooms also would not be allowed to have nm cable.

That is what I was alluding to. 518.4(A) does not permit NM cable as a general wiring method unless the construction is nonrated (518.4(B)).

A restaurant is listed in 518.2(A) as an example of an assembly occupancy.

Not exactly correct...NM can't be used if the building codes require the restaurant to be of fire rated construction. If the code would permit the building to be built of non-fire rated construction and it was built of fire rated construction, you could still use NM.

Agreed, but I very much doubt that someone would choose to construct a building using fire-rated construction unless it was required by code, due to the complexities and added cost of the rated construction.
