Is it acceptable to install Schedule 40 PVC conduit when stubbing out of a cement slab? If this is a NEC violation, please list the article.

It might be "legal" but many people would question if the conduit might well be subject to damage in such an installation. the rule of thumb seems to be anything that can be kicked is subject to damage.

Personally I would use Schedule 80.

But you can use Schedule 40: It's suitable for direct burial or encasement in concrete. Unless marked "Underground use only".
But when you say cement slab, do you mean dwelling drive way? Reason I ask, is because there is some code cover requirements. It is best to get a ruling from your AHJ on what they may define as subjected to physical damage. My definition may not agree with your inspector--this is why I prefer Schedule 80.

Yet, we would need more information: Where is this cement slap? Is the conduit going to emerg from the ground near a high traffic area? Is the location considered Hazardous? What do you plan to use this conduit for? Is this slab 2" thick or more?

Basically, if you are coming out of the slab to go into a future piece of equipment and it will be protected, no problem. If you are coming out of a slab that will be a patio and going into a meter fitting, it shall be schedule 80. We need more information. :D
