Try Article 334 Non-metallic Sheathed Cable.
Local codes may not allow use of NM in the application you describe. Also see annex E and NFPA 220.

AS Tom has said it would depend upon what your local or state codes/AHJ say. We have done a couple Holiday Inn Express's in NM, against my better judgment and our state went along with it as they said that it is a type 3 construction with 2 hour walls and the fact the building is sprinkled. AS this is what the builder demanded. But we did have to do conduit in meeting rooms and other places of assembly that 518.4(A) requires. You can switch to ENT as allowed in (C) of the same article, but why? as EMT will be cheaper.

If the local codes enforced approve of NM cable installation in buildings of 3 stories or more, why the fuss?
There are many, many buildings more than 3 stories that are wired in NM and there are no NM related problems because of it.
The concern of smoke threat is important, but otherwise I see no real 'danger' that may occur if it is installed properly.

Wayne just got the news from local supplier steel shortage E.M.T. jumped from 10.00 for 100 feet of half inch to 25.00 for half inch. But I will still use it over smurf tube. What is the cost in your area since this supply house is in South Bend.
