What you think about this situation. Rewiring an apartment in this 40 apartment building, four story building and basement floor, with basement floor around 5 feet above grade level. Wood framed but with brick walls to the adjecent apartment and to common areas. Walls are plaster and metal lath. (very old, maybe 1920's). Does 334.10(3) apply in this situation? The buiding is old but it is not type I or II.
NEC 2020 334.10(3) Other structures permitted to be of Types III, IV, and V construction. Cables shall be concealed within walls, floors, or ceilings that provide a thermal barrier of material that has at least a 15-minute finish rating as identified in listings of fire-rated assemblies.
