romex in three story dwelling

Is this rule obsolete in the 'o5 code book? If so, what article? I remember in my 1999 studies, there was mention from Jeff Rodriquez that it was not allowed and this was a frequent question.
I have looked throughout my '05 book and cannot find it.

This was taken out of the 2002 NEC and and is not in the 2005 either.
