Sounds like new construction. As a former building official, I think the permit would have to be changed, which makes the answer to your question "no".

I suggest asking the principal designer if they will reclassify the building.

The language of some parts if the code refer to "permitted [allowed] to be Type x ..." which does not refer to the building permit!
Another way of reading it would be that if Type X construction is not allowed then certain wiring methods should not be used.

There are other code sections which will apply regardless of the actual construction method.
 
I agree with GoldDigger, if a building is built as a type 1, (concrete and steel) but could have been built as a type 5, (stickframe) then yes, NM cable is permitted....You need to be careful
of fire walls, assembly areas, etc....
Determination of allowed building types can be found in IBC. A good architect though can usually find a quick answer.
