Im sure this topic has been beat to death, but looking for a definitive answer. A brick building with rubber roof. approximately 10,000 sq ft. mixed use. 1st floor front 1/2 existing office area with drywall and wood framing. back 1/2 1st floor being new construction wood framed with hard ceiling and drywall. 2nd floor existing office space with drywall and suspended ceiling. 3rd floor open storage area.
I am saying romex is allowed in the new part if there is fire rated drywall or other fire rated sheeting between commercial space and 2nd floor; sort of like making the new construction its own fireproof capsule.
Referencing 334.10 (3) Other structures type III, IV and V and provide 15 minute fire rating . Am I interpreting this correctly for the new construction portion of the remodel.
 
If its something your bidding against others on I would submit a RFI to the Architect or Engineer of record.
If your designing the job you'll need to look into the other local codes that impact those designations.
Also keep article 518 in mind.
Personally 10000 SQFT commercial building, as you described I'd use MC for branch circuits 15-40 amps and EMT for 50 amp's and up and feeders, and possibly home runs.
