safety switch mounted face up, violation?

I came across a Safety Switch mounted horizontal, face up, to a plywood floor in a mezzanine.

I haven't found where this installation has violated code, but I also haven't seen this before.

I did not note at the time if the switch is fused or not. If it was fused I could see it being in violation of 240.33 Vertical Position.

Are there other articles that may apply? Assuming it is not fusible.
 
If it's indoors then the NEMA rating may not be an issue. If it were outdoors that would probably be your violation. Nothing specific in the code, just 110.3(B), use listed equipment according to instructions. I have tried and failed to get manufacturer approval for other-than-upright positions for NEMA 3R switches outdoors. If it has a more robust NEMA rating then it's probably okay to be in that position.
 
preferred mounting for Chinese switch..keep the fuses from falling out :D
