Selecting a switch rating

Up in my neck of the woods it's pretty common that switched outlets are wired with #12 with a 15 amp receptacle on a 20 amp breaker, and a 15 amp toggle controlling it. Does 404.14 (F) forbid this? Im thinking a 20 amp switch is now required. What do you guys think?

Other than this scenario do you only use a larger switch to fit the required load?
 
Are you switching 1/2 of the 15 amp receptacle? If so the 15 amp switch would work because you could only plug in a load with a 15 amp plug.

Oh man that's solid right there. 99% of the time I do but was doing so to meet the requirements of 210.52. So with what you were saying in reality you are meeting the code twice by having a half switched outlet. But that still leaves the many up here who switch the entire duplex, or having multiple switched outlets on the same switch.
