I have a Baja self-contained spa, UL listing #WCZW.E117713, installed in my jurisdiction below grade. The listing is clearly for an above grade spa. The company says "they do this all the time". I even had a neighboring Building Official who was nice enough to call me on the behalf of the contractor and ask me what my problem was, he allowed many below grade installations in his city. Well, my problem is I don't consider 4" above the bottom of a pit above grade. I am not comfortable accepting a sump-pump as an alternative to a free draining above ground location. Does anyone know if UL has a definition of "above grade" or if they consider a sump-pump as an approved alternate?
