Service disconnect for Fire safety

When adding a generator automatic transfer switch you do need to add a disconnect for fire safety on the outside of a residence some inspectors tell me you have to add one and others tell me if you are not changing the meter socket you don't need one outside if you are not changing the meter socket and can mount a SE rated transfer switch inside next to the panel.
 
If the TS has a main breaker, then that is all that is needed. I don't have a copy of the newest code that will come out, but I've heard the emergency switch will be required, with some changes. The changes would be, if there is a disconnect there, it can be the emergency disconnect but can't be labeled "emergency disconnect, not service", as is allowed today. It would be both the service disconnect and emergency disconnect.
