service disconnevt

I recently came across a situation where the service enters the building from the meter. it is a 3 phase 208v service. On the load side of the disconnect, the installing electricians only used 2 phases of the load side to create a 208v single phase service. Im not sure if this was legal. Can anyone help me clear this up?

I don't see any code issues with that other than you would have to count the grounded conductors of any mutliwire circuit as current carrying conductors for derating purposes.
