short circuit rating of equipment

If my available short circuit at a CB is 40Kamps can I install a circuit breaker that is rated at less than the 40K amps? Where in the code does it state that the equipment needs to be rated for the application?

C B = Circuit Breaker ? If your system AIC is 40 k it might be possible to install a breaker with a lower rating if the system is series rated and the combination of breakers is listed, or if the system 40k has been reduced by wire length, etc (engineering data).
If, on the other hand,m you know the AIC at the point you are installing the breaker is 40k, then the breaker must be rated at least 40k
