single pole vs 2 pole breaker

This should be easy but...
Tech called in and asked if he could use 2 single pole 20 a breakers for a 220v heater. He was at a customers home and the heater was replaced, 120 to 220. He did not have the proper 2 pole breaker on the truck. I stated that we needed a 2 pole, he said he didn't think it was required.
I couldn't find it in the code but i was sure it was in there some where.
would 2 singles be leagal if properly labeled?
( we did put in a 2 pole)
 
240.20(B) requires circuit breakers to open all ungrounded conductors of the branch circuit both manually and automatically unless otherwise permitted in 240.20(B)(1), (B)(2), and (B)(3).

A handle tie will not necessarily trip the other breakers automatically when one breaker of the handle tie assembly trips.
 
For this application, 240.20(B)(2) permits the use of single pole breakers with a handle tie. It does not require a common trip breaker.
