Sizing breaker size for a range/oven

I have a range spec sheet that says 40Amp rating for a 208V. But then it also says rated 12KW. How do you typically size the breaker?

This is not a continuous load: so typically i do 40AMP breaker with a #8 copper. Should i increase the breaker to 50AMP with a #8 copper?

You look at Table 220.55 Note 4 which says "It shall be permissible to calculate the branch-circuit load for one range in accordance with Table 220.55." Any range from 8-12 kW nameplate is a load of 8 kW per the first row of Column C.

8 kW @ 208V = 38A, so a 40A OCPD with 38A ampacity conductor suffices.
