Sleeving NM

I have a motel being wired an accordance with 334.10(3).
The contractor had plans to bring the NM into the surface mounted panel thru sleeves, but 312.9(C) will not allow the sleeves to penetrate the structural ceiling.
If he stops the sleeves below the ceiling, the NM is not concealed by a 15 min rated barrier.
Anyone know a simple solution?

I assume this is a surface mounted deal. Yes? Just build a wall 3.5" thick above the panel and sheetrock it.
 
another local inspector, wiser than I, suggested that, and it appears that may be the best solution. I did wish to throw it out for other possibilities.

We had the same situation and used aux gutter extentions atop and bottom of each panel. We fire caulked the sheetrock where the cables came down through.They mounted quite easily.
