I have small, roof mounted exhaust fan with a 1/8HP motor @ 120VAC. The circuit runs through a 3-postion switch, 'HOA' mounted on the front cover of a local control panel at grade. The HOA which is readily accessible. A lockable CB, located within the panel provides overcurrent protection and there's a disconnect switch within the fan housing however neither are ‘readily accessible’. The motor also has internal thermal protection. (Looking at 430.83(C), 430.102B)(2), 430.103, 430.109(B) and 430.109(C).

Is this installation NEC compliant since the fan motor is only 1/8Hp?
