spacing between bare metal parts

Hello

I went to a substation to check automatic transfer switch then I found that there is no distance between the terminal lugs for load and normal power sides. The contractor installed a rubber as insulation between the terminal lugs and I think it is not a listed rubber.

So can I use table 408.56 in NEC 2005 as a reference to determine the distance between terminal lugs?
Is the opposite polarity mean the different phases?

Three phase cables for load & normal power supply were terminated by terminal lugs in the terminals of Automatic Transfer Switch & this switch was relocated to new substation. This switch is manufactured but it looks old brand. The distance between terminal lugs about 5 mm & the contractor installed a rubber as insulation between terminal lugs
