I have a few questions regarding AHJs and requesting consent for a variance. I did read this post but it didn't really outline any procedures.
I am in NY and they do have a dedicated form for applying for a variance, but I do not know if they are always considered the AHJ. My understanding (correct me if I'm wrong) is that the AHJ is often a local authority who I imagine is delegated power by the state to grant variances and make other code related decisions. Filling out that form seems like it would be going around any local AHJs.
My first question group would be: Are there multiple AHJs like a state and county AHJ? And who would I request special permission from?
My second question group would be: What is the formal procedure for requesting special permission (when there is no online form)? Do I need to ask the local AHJ for a variance form to fill out? Can I email them and count their response as written consent if they permit the variance? Are there any features that the procedure must have to be valid?
