Splicing Service Entrance Conductors in 1200 Amp MDP

We have a solar company who wants to remove 4 sets of 350kcmil from a 1200 main service breaker in a MDP and install a 5 lug polaris kit to accomodate a new 350kcmil conductor fed from a 95 kw PV inverter. These large 4 splice kits will be installed in the 1200 amp vertical section..which will consume the side gutter section, but still be less than a 75% fill. The 1200 amp breaker only has 4 lugs for each phase We have come up with some other compliant methods, but this is the least expensive. It's a 1200 amp buss, so the 300 amp backfeed would violate the 120% rule found in NEC article 705.12(D).

Question: Would you allow the service conductors to be spliced in the MDP to accomodate a fifth conductor for each phase and grounded conductor? The fifth conductor being the utility interactive feed from the inverter. The system is 120/208, 3 phase.
 
What code section could be used to stop them?

Seems like a reasonable solution and not unsafe even if ugly.

I assume they will hit an OCD immediately.
