"Stay Open" weatherproof covers

I know that the weatherproof covers that aren't while-in-use are now considered wet location only when cover closed, so they're only suitable for damp or dry locations. How does the code change affect the covers that are called "stay open"? Technically when closed, they should function the exact same as the other receptacle covers with the spring-loaded self closing mechanism, so it seems like they should still have the same UL listing status; however, I have seen some stay-open covers that say they are not UL listed and some that say they are. Why is there a difference?
