Sub panel mounting

I got a job that a local inspector in Deleware is telling me that you can't mount a two circuit sub panel horizontal. It is not a local code is it a NEC? Or is he wrong?

Which way do the breakers operate?
Side to side or Up and Down?
If Up and Down, which way is 'On' ?
