Surge suppression for sub panels?

We installed a EV charger in a garage of a dwelling. The service for this dwelling is an exterior 200a main breaker 30 circuit panel. There is also an exterior 100a 12 circuit sub panel mounted next to the service panel. We replaced the sub panel with a 24 circuit panel in order to make room and move some branch circuits from the service panel to the sub panel in order to make room for the EV breaker in the service panel.

We failed inspection due to no added surge protection to the replaced sub panel per 230.67 which applies to services which the sub panel is not considered part of services. I felt like I had an argument here to dispute this due to it not being part of the service.

However after a little digging in the code I found 215.18 which refers to surge protection for feeders. Which in my mind does require surge protection for the sub panel.

It appears the AHJ ultimately got this right but quoted the wrong code reference. Am I seeing this correctly?
 
I would argue that a relatively closely coupled sub panel is protected by the surge protective device in the main panel. Barring a direct lightning strike, you would not be able to introduce a surge between the two panels.
