Swimming pool outlet requirement

The question is about the convenience receptacle required >6ft < 20ft from the pool. The way it was installed is off of the wet niche circuit. The contractor has 2 niches installed all ran in raceways with proper size conductors on gfci breakers and all. That part looks good but off of the last niche j-box he ran a raceway over to a receptacle that is located per 680.22; did not splice grds per 680.23F (2), used the terminal left in the niche j-box required per 680.23D for receptacle eguipment grd conductior. I cannot find anything in NEC that says that this outlet cannot be on with the niches. My boss is the CBO and thinks that it should not be on a circuit switched with the niches because it is not convenient to have the niches on during the day just so the owner can have use of a radio plugged into the receptacle. So is this is a 90.4 call? Does anybody see anything different?

Per the definition of a General-Purpose branch circuit it looks like the receptacle could be on the same circuit as the wet niche lights. Section 680.22 (3) does not mention that a receptacle could not be switched.
