Swimming Pool Pump Placement

I have a client that is building a pool. He received a permit and the design of the new in-ground swimming pool was ?approved?. The house has a relatively small yard. Recently, it was discovered that the City has ?revoked? (though not in writing) the permit. The question is the location of the electrical pump. The client has planned a four-foot vertical wall on the side of the pool (as part of the pool structure) and was going to hide the pump behind the wall?out of sight. The client was also going to cover the pump with a wooden box to keep it out of the elements. The City seems to believe that the pump must be at least 5 feet away from the water level, but in reality no one knows if that is ?as the crow flies? or if vertical distance is permissible. Also, no one seems to know of any Code section dealing with the issue if the electrical connections are also covered. Any thoughts and/or citations to specific sections of the NEC would be very helpful. Thank you.
