Swimming pool question

I recently saw a code question presumably written by the IAEI. Here it is.

A fountain that has water common to a pool shall comply with all of the provisions for:

A. Permanently installed swimming pools
B. Pools
C. Fountains only if no lighting is installed in the fountain
D. Fountains only if no lighting is installed in the pool

The answer given is "B". Does anyone think, like myself, that it should be "A"?

680.50 General.
The provisions of Part I and Part V of this article shall apply to all permanently installed fountains as defined in 680.2. Fountains that have water common to a pool shall additionally comply with the requirements in Part II of this article. Part V does not cover self-contained, portable fountains not larger than 1.5 m (5 ft) in any dimension. Portable fountains shall comply with Parts II and III of Article 422.

680-50. General
The provisions of Part E shall apply to all permanently installed fountains as defined in Section 680-4. Self-contained, portable fountains not larger than 5 ft (1.52 m) in any dimension are not covered by Part E. Fountains that have water common to a pool shall comply with the pool requirements of this article.

Any underwater light that is not fiber optic with a dry light source back at the pump room is a DINOSAUR! Please resists buying a direct wired light at a closeout sale.

I don't know if this makes a difference, but I notice it says it has water common to a "pool". It does not say it has water common to a "permanently installed pool".

But I find it really hard to imagine a fountain sharing water with a temporary pool :confused:

I have to agree with IAEI (b) Pool is the technically correct answer. See the Definition of "Pool" in 680.2 Definitins.

Pool. Manufactured or field-constructed equipment designed to contain water on a permanent or semipermanent basis and used for swimming, wading, or other purposes.

What other "purposes"?

to hold water for a fountain
