What section of the code applies to a cable-lug buss tap inside a switchboard to an exterior mounted circuit breaker? Does Article 240 or 368?

I have a situation where the contractor needs to set a new distribution panel adjacent to an existing switchboard that doesn't have space for an additional circuit breaker. The cable would be run through a 12" conduit nipple between enclosures and terminate in the distribution panel main circuit breaker. Does this violate code or does it fall under one of the tap rules?

I don't think article 368 applies to the inards of a switchboard.

IMO, it is a pretty basic tap, and should follow the tap rules.

If it was me, instead of a single CB, I might consider wiring in a whole new PB, if there is capacity to do so. If you need one CB now, chances are you will need another down the road.
