Sorry brain fart day. Have a 40 amp breaker feeing 2 #8 to a j-box from j-box to 2 disconnects there are #12's. Disconnects are only about 2 feet from the j-box. Disconnects will feed two pieces of equipment that will be installed at a later date.

Is this install complient? Never seen it before.
 
I would call it compliant with 240.21(B)(1) if, and only if, the disconnects were fused, and the fuses were no higher than 20 amps.

OK thanks Charlie, that's what I kind of came up with too.

Just one of those where you wonder, why didn't you just run the #8 the rest of the way?
 
Depedning on the type terminal, perhaps the lugs on the disconnects are more suitable for the #12s ???

Must have been something kind of unusual about it that one has to see to be confused, otherwise you described a feeder and legal feeder taps pretty well.
 
Is the equipment grouding conductor ran with the taps sized to the upstream 40 amp OCPD, if not it wouldn't be code complaint.

250.122(G):

(G) Feeder Taps. Equipment grounding conductors run with feeder taps shall not be smaller than shown in Table 250.122 based on the rating of the overcurrent device ahead of the feeder but shall not be required to be larger than the tap conductors.
