tapping a tap

Sometimes I don't know if I'm the boxer or the bag

Sorta retired........
in other word I am tapping a #4 to a 3/0. Am I allowed by code to tap the #4 with a #12? Both will land in properly sized overcurrent protective devices.
one tap is for a surge arrestor the other is powering a relay.
 
Check out 240.21.

240.21 Location in Circuit. Overcurrent protection shall be
provided in each ungrounded circuit conductor and shall be
located at the point where the conductors receive their supply
except as specified in 240.21(A) through (H).
Conductors supplied under the provisions of 240.21(A) through (H)
shall not supply another conductor except through an overcurrent
protective device meeting the requirements of 240.4.
