Tapping off of a disconnect switch

I'm moving a three phase compactor Bailler the closest power is from a three phase circuit supply a transformer for a 240 volt breaker panel . Would like to now if a can legally tap off the top of the disconnect

Probably not, I wouldn't.

What is the existing disconnect feeding?
What size is the disconnect?
What size are the fuses in it?
Are the lugs on it rated for more than one conductor?
What's the load kVA for the bailer?
What happens when someone panics on the bailer and uses that disconnect to kill power? Does it then plunge everyone into darkness just when they are trying to extract someone who got their sleeve caught in the bailer? (I ask because that happened once on a project I worked on).

you certainly can if you meet all the criteria for a legal set of tap conductors.

I believe he wants to tap the supply side of the disconnect in question which might change your questions to some extent.
