Situation: I am on a Construction site and we are using temporary lighting circuits. Now we are coming to closing up the ceilings. My electrical contractor has installed temporary branch circuits with NMC and receptacles. Now on the tear-out, he says that he is well within code to pull the wire leaving the NMC Sheathing in place affixed to the Structure.

Question: according to Article 590 Temporary Installations 590.3(D) states temporary wiring shall be removed upon completion of construction or purposes for which it was installed. Does this include the Sheathing? it doesn't seem right to me to leave NMC sheathing. Any thoughts would be greatly appericaeted.

Are you saying that the conductors within NM cable will be pulled out leaving just the outer jacket?

It is no longer wiring if the conductors are removed. Personally, I think it would be more work to remove the wires from inside the sheath and leave the sheath in place as opposed to just pulling it all down. If it is stapled in place, it should not be real hard to yank on it and take the staples out.

Well if he is leaving it through rated partitions tell him he'll have provide a UL "through wall penetration" assembly with back up from the UL fire directory or a manufacturers drawing. (y)

my apoligies> Metal-clad cable is being used. wrote the wrong thing last night. The MC cable is secured to the structure via some sort of beam clip. and they are pulling the wire out from Cladding and leaving it attached to the structure.

Since it's MC then I agree with Bob this is not an NEC issue. As Roger mentioned rated partitions are a different issue.

590.2(A) states that all other articles apply to temporary installations so one could argue that leaving the PVC jacket in a ceiling used for air handling is an NEC issue.
is it a nec code violation to glue a piece of NM jacket to a wall? suppose it was part of an art project?
