TENV Motor in Class I Div 11

I have a Class I / Div II area at a loading dock. The Owner is questioning the installed dock leveler motor. The motor is a TENV, and the manufacturer states its not arc producing. Manufacturer statement below.

The standard Rite-Hite 3-phase TENV electric motors, shipped with all standard pit-style and vertical-style levelers, complies with the specified requirements of statement (3) as highlighted below. Please note that: 1. Statement (4) does not apply to this installation. 2. 3. The standard 3-phase TENV motor, in this application, meets the requirements of statement (5) through the use of non-isolating shaft bearings. The standard 3-phase TENV motor, in this application, must be isolated from all other components or assemblies, within this same environment or at the border between (2) different hazardous environments, through the proper installation of a Nema 7 Explosion-Proof Conduit Seal Fitting.

So, the manufacture is stating they comply with (3) and (5).... and (4) is not applicable, and that appears to satisfy 501.125 (B). Anyone have a different opinion or other information that would conflict with this?

It is typical to install 3 phase motors that do not have any internal switches or other arc producing parts, in Class I, Division 2 locations. I agree that 501.125(B)(3) applies and would even permit an open motor.
