Three phase service connected to single phase main?

Can anyone see why it would not be allowed for a customer with an existing three phase service, who only uses single phase equipment, to leave C phase in the meter socket and install a single phase main panel only connected to A and B phase when replacing equipment? They do not see why they should install a three phase main.

It will work and nothing in code is in violation either.

Might cost less to subscribe to single phase from the POCO though. Won't have to change meter socket, single phase meter will plug into A and C jaws.
