time clock on heater opinion

My boss (master electrician) and I have a little difference of opinion. He was installing a time clock on a 240v heater. There was no common only 2 hots and a ground, the time clock is 120v. He hooked up the "common" from the time clock to the ground and said it is safe. I disagree, and told him we need to pull a common back to the panel. Opinions anyone?

You are right. It is a violation of 250.24(A)(5) (2005 version), and creates a violation of 250.6(A). He just turned the entire set of equipment grounding conductors and all conduit and external metal parts throughout the building into current carrying conductors.
