I am sure that the rules that apply to any given jurisdiction will have been developed on the basis of the lawsuits that have, through the years, been prosecuted in that jurisdiction. This may be a question that only a lawyer can answer.
You might be able to get some information from a local public library, though they won?t be able to give legal advice.
