TV mounted above a hydro massage tub

Is it ok to mount a TV, when protected by a gfci, above a hydro massage tub. Look at 680.71 and 410.4 [D]. Thanks. I say it is ok, another inspector says it isn't based on 410.4[D]. I dont think a television is classified as a luminaire.

406.8(C) Bathtub and Shower Space. Receptacles shall not be installed within or directly over a bathtub or shower stall.

How does this work?

What do you mean "above"? If the TV is, in fact, above the tub, a person in the tub won't be able to see it. If it is within the viewing angle of a person in the tub, then it won't be above the tub, and installing a receptacle for its use will not be a problem.

Receptacle 9' above the tub, gfci protected, tv hanging off wall within tub space.

I'd say you could mount it above the tub if the receptacle is located outside of the edge of the tub. A TV is not a luminaire and isn't explicitly prohibited above the tub. Only the receptacle is. Maybe one could argue that the TV would be listed for a damp or wet location but that may be stretching it.

How did you come up with 9'? This would be a violation of 406.8(C)

I think he is saying that the receptacle is mounted on the wall (i.e., not above the tub), nine feet off the floor. That is not a violation of 406.8(C). Only the TV is above the tub, though I still don't see how that is of any use. If the tub is intended for therapy, then why would you make the user strain his or her neck, in order to look up to the TV?

I agree that the receptacle can be anywhere outside of the tub's edge, but I was wondering why it was mounted at 9'?

Have you seen the size of some of the bathrooms lately? The tub/hydromassage enclosures themselves are also quite large... and I myself have seen a large number of people/architects specifying the installation of TVs in the tub/massage enclosure area.

Are you trying to say that the tv is safe hanging 3' above the tub? Why is a light restricted in the 3' - 8' area and not a tv?

No it is not safe.

The inspector can control what is permanently installed through a set of rules such as the NEC but, no one can control the homeowner.

Sorry, I came in late on this one. Great picture looks like an electrical "suicide" to Me. Where is the receptacle in that mess?

The tv,and the rest of that mess are only plugged in.So hence no 3/8 ft rule to apply in this situation.
