Is there any place in the code that says the 90 degree elbow has to to be fully below grade before the stub up comes out of the ground?

Only consideration I can think of would be that if part of the curvature or top of the 90EL is exposed the implication might be depth of the burried conduit is inadequate. A 1/2 inch EL with such exposure would definitely be red flag for depth being inadequate, where a 3 or 4 inch EL with similar exposure less likely a depth concern. All depending upon circumstances of installation.
So if your minimum depth (per Table 300.5) can be maintained for the conduit up to the elbow it is possible for a portion of the elbow to be exposed and code compliant.

Don't know if it's applicable here, but I have used two 45s to get around the edge of a footing.
