Unfused primary taps

I am working in a house that has no overcurrent protection on a set of tapped conductors located in a gutter in the attic. The panels fed by the taps are within code, but the gutter is accessible and has no cover on it. I tried to close the gutter with the cover and it started arching, very unsafe. I am proposing to the client a service change to get rid of this unsafe condition, but need to give code which will back this up. I believe that a primary cannot be tapped this way, but need some expertise on this.

By "primary", I assume you mean service conductors from the meter.
The Code section I would use is 230.70(A)(1)

Hmmm... that subsection is only regarding the service disconnecting means. What does that have to do with a gutter containing se conductors and taps thereof in the attic?

If it's after the meter and before any disconnect, I'm wondering exactly where is the meter... on the roof??? ;)

Where are the panels in relation to the gutter? If the gutter is in the attic, the panels need to be adjacent thereof, or else the disconnecting means is not near the point of entrance... and disconnects of said panels would need to meet the six-pack rule.

We need more details on the layout...
