Upgrade of GFCI in a apartment,

A question for the smart people out there. I live in a apartment that was built in pre 1987. My garbage disposal went out and upon inspection I found that it had leaked out the bottom and was sitting in a crock pot in water. Nothing tripped when it was turned on just the lights dimmed. There are several problems (like it is on a 40 amp breaker), it is plugged into a outlet under the sink on a non GFCI outlet that is fed from a light switch on the counter. The second outlet is the dishwasher. What is required from a code perspective? First all the outlets within 6 feet of the sink are "NOT" GFCI. All the outlets and plugs were updated way after 1987. It is my interpretation of the code that if the outlets and electrical is updated then it must meet the current code at the time of update. What are your answers? The apartment people are saying that it falls under the code of when it was built all though all the electrical and appliances were replaced in the kitchen within 10 years. The current city code is 2011. And yes I know the breaker is far from correct. The major issue is what does the code say about installation of GFCI's and the date when the apartment was built.
I am a journeyman electrician and a electrical engineer for 25 years but I deal with industrial only. The code is the code but I think I am right on this in that they must install GFCI outlets in all kitchen outlets within 6 feet of the sink (on the counters and the disposal) since they were replaced since 2005. Please help.
