Upside down panel?

I am a project manager for an MEP firm in Dallas and I came accross an existing 42 pole, 120/208V, 3 phase panel mounted upside down on a restraunt remodel I am working on in Grapevine, TX.

Any thoughts on if this is code compliant? Should I leave it as-is, or have the contractor correct it?

As long as the main device, if one exists, reads ON when up and OFF when down, there is no code reason against this installation. Many manufacturers actually print their labels in a manner that allow "upside down" mounting.
 
240.81 Indicating.
Circuit breakers shall clearly indicate whether they are in the open ?off? or closed ?on? position.
Where circuit breaker handles are operated vertically rather than rotationally or horizontally, the ?up? position of the handle shall be the ?on? position.
 
As Jim said , It is fine. It some times makes for a neater job inside the panel. Because you don't have the feeder wires running all the way up and around.
I will add. Some breakers will be off side ways. Off one way and On the other. This is how most of the reversible panels come.
Other wise if a panel had a staight up and down Main breaker then when you turned it upside down the on would be down. Which as Jim said would be a code violation.
If this is a sub panel you probably don't have a main at the panel so it would not be relevant.
