Using an 8/2 MC for a 240v 2 pole AC

In Jacksonville, NC the Electrical code is under NEC 2011. I am using 8/2 MC for a 45 amp single phase Air Handler and wanting to phase the white as a red. Under 2011 code is this legal? The inspector is questioning the method.

If you not using a continuous length, remember to identify the white wire everywhere is pops up along the way.

Is 45 amps the MCA or MaxOCP ?
I ask only because if the MCA is 45 and the unit is marked for 60? terminations, you would have a problem.
