I'm slightly confused, is the wire for the fan? or for the thermostat?

if fan: no

if thermostat wiring : It could be ok depending on wire type

250.119 read all - note Exception, I doult you'll make that exception.

In the Article 100 read Grounded, Solidly or determine if its a Grounding Conductor, Equipment (EGC)

He should meet the exception. When I was working with the tools the green thermostat wire was the usually hooked up to the fan circuit. That qualifies as a class 2 circuit.

Agreed, T-stat wiring is one of the things that prompted the addition of the exception to 250.119.
