Utilities are typically required to meet NESC requirements for installing electrical facilities. The customer has the ability to purchase the facilities and be primary metered. The question is: If the customer elects to purchase the utility's facilities will the customer be required to insure that facilities are up to current NEC code standards?

It depends on what happens. :cool:

If the customer cuts a deal with the electric utiliy for the exclusive control of the facilties stay in the hands of the electric utility, then the NESC still applies and only a meter would be installed at the point where ownership changes. The customer would own the facilities but would have no control over them.

If the customer were to rent the facilties from the electric utility and the electric utility maintains exclusive control of the facilties, then the NESC still applies and only a meter would be installed at the point where the rented facilities begins. The customer would rent the facilities but would have no control over them.

If the customer were to purchase the facilties from the electric utility and the electric utility turns over control of the facilties, then the NEC applies and not only a meter but also service equipment would be installed at the point where the customer's facilities begins. The customer would own the facilities and would have control over them.
