Utilization of 3-Pole breaker for Single Phase loads

Hello,

If 100A, 3P circuit breaker (inside 120/208V, 3-Phase Panelboard) is used to feed 100A, 208V, 1PH load will this be a code violation? One-Pole not used/connected. If yes what code section would that be under?

There is no code requirement that all poles of a protective device be used. UL489 listed breaker have been tested using the different pole combinations.
