vendor cables physically protected from damage?

I'm trying to make the argument that the cables are 'protected from physical damage', even though they are exposed for about 30". The cables emerge from a 1" conduit, routed near grade and are connected to instruments associated with VFD motor, such as encoders etc. They only drop a couple feet and seem to 'inherently protected' by the surrounding vendor equipment, but not sure this is sufficient per NEC.
