Weekly Dumb Question-- Taps ?

A 200A fused disconnect switch with 150A fuses is fed by 1/0 service conductors. On the load side are duplex lugs.

Can the tap rules of 240.21 be applied to conductors fed from these duplex lugs ?

E.g. #8 s can run less than 3m in conduit to a subpanel where they
are protected by a 40A breaker ?
 
Thanks guys. I don't run into this situation that often, and have to refresh my memory.

One more question: say I run over the 10 feet, it will only be a few inches, maybe a foot. Now I am into the 25 foot tap rule.

#8s are 50A in the 75 degree column, 1/0 is 150. So that is still OK. But in the 90 degree column it comes out a little
less. Should it be upsized to #6 or is the 75 degree column OK since that's probably what the lugs are rated ?
