What codes are in violation?

I will be installing a couple of baseboard heaters in an attachment off of a kitchen. Right outside of this attachment is the disconnect for the AC condenser. It is fed from the main panel by a two pole 20amp breaker. The owner would never run the heaters and the A/C simultaneously. My question is what code rules would be violated by tapping off the line side of the disconnect to feed the two baseboard heaters? Other than perhaps the lugs not being rated for two conductors.
 
Did the same thing at my house only in reverse. Tapped the circuit feeding the baseboard heater to feed an outlet for a window A/C

I had an emergency call several years ago where this was done, except to an outside unit as part of an illegal central-AC installation, along with an un-permitted, un-inspected, un-safe 200a upgrade, without ever changing the 100a meter or service cable, promptly burning through one of the meter lugs, causing a call to the POCO which compelled them to pull the meter, plunging a new couple with a new baby into helplessness in the middle of a heat wave.

I pulled a permit for an upgrade (which the POCO cooperates with free) and corrected all of the issues with the panel, got everything inspected, the upgrade completed, the power was restored, and the family was able to return home. Too bad the HI missed all of the errors both inside and outside the panel, and gave a positive review of the recent upgrade that I had to charge them again for. I gave the new parents a couple of extras as a "house-cooling" present.
