If someone had a 15amp breaker with #14awg wire feeding a junction box for a gas fireplace and someone took the #18awg stranded cord, cut the plug off and wired it directly into the junction box instead of installing a receptacle.

Would this be a violation?
What section and paragraph(s) cover this violation?

210.19 (A) (4), 110.3 (B), 430.102 (B), 422.32.
Both 430 and 422 can be complied with by installing a switch for the fan.

The cutting of the cord alters the listing of the appliance and would need to have a third party field inspection. It won?t take but one field inspection to teach this guy not to cut any more cords.

It is never ever possible to say that a field modification will violate a UL Listing. According to UL's website the only way to know is to have it field inspected. Final approval of any installation is upto the AHJ.

There are many common field modifications that are acceptable, like punching conduit entry holes or replacing molded plugs that have been damaged. Taken to an extreme, are you violating a listing by using "good" wirenuts instead of the cheap ones supplied by a luminaire's manufacturer?
