WHEN IS A E-BOX CONSIDERED BURIED?

We installed a piece of track were a recessed can had been. In doing so we had to install a j-box to accommodate some splicing. This bow is only accessible with the track removed much like the one that came on the track itself. Is this within code or not?

As long as you have access to the box when the fixture is removed, you are good.

410.13(B) is sometimes confused for other than electric-discharge type fixtures, where access is required with the fixture installed.
