when is a panel considered a raceway?

Fellow code crunchers, I have encountered a situation on the job where my load side to lighting circuits are coming up into my normal power panel however there is a lighting contactor connected above the power panel and I need connect my load to this contactor. My line side feeds from the breakers in this panel. I have never had an inspector saying I could not do this please help.
 
It's done every time we install a small EM generator panel next to a main panel. Just figure the requirements of 312.8
 
I guess I wasn't like being clear my inspector says that I am using panel as a raceway by passing of what my load side wires through my panel to my contactor and the code reference you gave me is what I thought I did related I am NOT as a raceway

But that does not mean you can't use it for splicing and pulls.
Read it carefully.

What else are you going to use it for? The only restrictions are the fill requirements and the labeling required if you have feed thru conductors.

What you are doing is using the enclosure as a raceway.

But 312.8 directly allows it, your inspector seems to be mistaken.

That does not mean the inspector is new (as you were unaware of the issue as well and reached out for assistance, or confirmation of your belief). Remember that inspectors do not know it all and are doing a job just like you. We learn something new or re-establish a concept we already kinda knew on a daily basis. So yes, cut him/her some slack as it is always a team effort.
